1. Agreement to Terms

By accessing or using ModelsRanked ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform. We reserve the right to update, change, or replace any part of these Terms by posting updates on this page. Your continued use of the Platform following the posting of any changes constitutes acceptance of those changes.

2. Eligibility and Account Requirements

Age Requirement: You must be at least 18 years of age to use this Platform. By using ModelsRanked, you represent and warrant that you are 18 years of age or older.

Account Creation: When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Account Security: You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Content and Conduct

Content Ownership: You retain all rights to any content you submit, post, or display on or through the Platform ("User Content"). By submitting User Content, you grant ModelsRanked a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the Platform.

Content Standards: You agree that all User Content must:

• Be accurate and not misleading
• Comply with all applicable laws and regulations
• Not infringe on the intellectual property rights of others
• Not contain harmful, offensive, or illegal material
• Not include personal information of third parties without consent

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate at our sole discretion.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Copying, distributing, or disclosing any part of the Platform in any medium
• Using any automated system to access the Platform
• Transmitting spam, chain letters, or other unsolicited communications
• Attempting to interfere with, compromise, or gain unauthorized access to the Platform
• Impersonating another person or falsely stating your affiliation with a person or entity
• Collecting or tracking personal information of other users
• Harassing, abusing, or harming another person
• Using the Platform for any illegal or unauthorized purpose
• Creating multiple accounts to circumvent restrictions

5. Intellectual Property Rights

The Platform and its original content, features, and functionality are owned by ModelsRanked and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ModelsRanked. You may not use our intellectual property without our express written permission.

6. Payment and Subscription Terms

Featured Listings: Creators may apply for featured placement on the Platform. We reserve the right to approve or reject any application at our sole discretion.

Fees: All fees are quoted in U.S. dollars unless otherwise specified. We reserve the right to change our fees at any time with reasonable notice.

Refunds: All sales are final. We do not offer refunds except where required by law or at our sole discretion.

7. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ModelsRanked, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

9. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. ModelsRanked makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included therein.

You expressly agree that your use of the Platform is at your sole risk. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free.

10. Indemnification

You agree to defend, indemnify, and hold harmless ModelsRanked and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Platform, your violation of any term of these Terms, or your violation of any third party right.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Platform shall be resolved exclusively in the courts located in the United States, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
